A Santa Barbara Superior Court Judge has indicated that she intends to dismiss some, but not all, of the allegations that actor Rob Lowe and his wife have made against their former nanny Jessica Gibson.
The judge has also indicated the she will dismiss the nanny's claim that the Lowes retaliated against her by filing a lawsuit.
In a tentative ruling posted on the court's website Judge Denise deBellefeuille has stated that she intends to dismiss the Lowes' claims that Gibson defamed them, intentionally and/or negligently inflicted emotional distress upon them and that she abused the process of the court when she filed a cross-complaint in response to the Lowe's bringing suit against her.
The judge also indicated she intends to dismiss one of Gibson's claims that she filed against the Lowes: the one alleging that their initial lawsuit filed against Gibson was in retaliation for her exercising her rights as an employee.
Other allegations that Gibson and the Lowes have made against one another will remain intact indicating that the bulk of each respective lawsuit is headed towards a trial.
The attorneys will have an opportunity at the oral argument Thursday morning at 9:30 a.m. to try to persuade the judge to change her tentative ruling.
